| Cam kết của Elite Care Do đặc thù dịch vụ chăm sóc tại nhà, Elite Care thường xuyên phục vụ người cao tuổi, người bệnh nặng và gia đình đang chịu áp lực chăm sóc. Elite Care cam kết không lợi dụng tình trạng dễ bị tổn thương để thúc ép giao dịch, không phân biệt đối xử và ưu tiên cơ chế hỗ trợ phù hợp để người tiêu dùng hiểu rõ, lựa chọn và thực hiện quyền của mình. |
1. Đối tượng được bảo vệ
Theo Luật Bảo vệ quyền lợi người tiêu dùng, người tiêu dùng dễ bị tổn thương là người có khả năng chịu nhiều tác động bất lợi về tiếp cận thông tin, sức khỏe, tài sản hoặc giải quyết tranh chấp tại thời điểm mua/sử dụng dịch vụ, bao gồm:
Người cao tuổi theo quy định của pháp luật về người cao tuổi.
Người khuyết tật theo quy định của pháp luật về người khuyết tật.
Trẻ em theo quy định của pháp luật về trẻ em.
Người dân tộc thiểu số; người sinh sống tại vùng đồng bào dân tộc thiểu số và miền núi, hải đảo, vùng có điều kiện kinh tế - xã hội khó khăn hoặc đặc biệt khó khăn theo quy định của pháp luật.
Phụ nữ mang thai hoặc nuôi con dưới 36 tháng tuổi.
Người bị bệnh hiểm nghèo theo quy định của pháp luật.
Thành viên hộ nghèo theo quy định của pháp luật.
Ngoài các nhóm luật định, Elite Care có thể áp dụng biện pháp hỗ trợ tương tự cho người đang suy giảm nhận thức, khó nghe/khó nói, khó đọc hiểu, đang trong tình trạng sức khỏe yếu hoặc gia đình có hoàn cảnh khiến việc tiếp nhận thông tin và ra quyết định gặp khó khăn.

2. Nguyên tắc bảo vệ
Tôn trọng nhân phẩm, quyền riêng tư, quyền tự quyết và lợi ích hợp pháp của người được chăm sóc.
Không kỳ thị, phân biệt đối xử hoặc lợi dụng tuổi tác, bệnh tật, khuyết tật, hoàn cảnh kinh tế, sự phụ thuộc hoặc tâm lý lo lắng để ép mua/duy trì dịch vụ.
Cung cấp thông tin rõ ràng, dễ hiểu, đúng phạm vi; không dùng cam kết điều trị, ngôn ngữ gây sợ hãi hoặc tạo cảm giác “phải mua ngay” để chốt dịch vụ.
Ưu tiên an toàn và lợi ích của người được chăm sóc khi có xung đột giữa mục tiêu bán hàng và nhu cầu thực tế.
Hỗ trợ người tiêu dùng thực hiện quyền khiếu nại, yêu cầu giải quyết tranh chấp và quyền về dữ liệu cá nhân bằng cách thức phù hợp với khả năng của họ và phù hợp với quy định của pháp luật.
3. Cơ chế hỗ trợ khi tư vấn và giao kết
Giải thích dịch vụ bằng ngôn ngữ đơn giản; chia nhỏ thông tin về phạm vi, giá, lịch, trách nhiệm các bên, rủi ro và giới hạn chuyên môn.
Cho phép và khuyến khích có người thân/người hỗ trợ/người đại diện tham gia khi người tiêu dùng mong muốn, nhưng vẫn tôn trọng ý chí của người được chăm sóc trong phạm vi pháp luật cho phép.
Kiểm tra lại sự hiểu biết bằng cách tóm tắt các điểm chính và hỏi người tiêu dùng có cần giải thích lại hay không.
Không yêu cầu ký/xác nhận khi có dấu hiệu người tiêu dùng không hiểu nội dung quan trọng, đang trong tình trạng cấp cứu, mất tỉnh táo hoặc có nghi ngờ về năng lực đại diện; trường hợp cần thiết phải xác minh người đại diện hợp pháp/được ủy quyền.
Cung cấp bản sao hợp đồng, báo giá, kế hoạch chăm sóc hoặc nội dung xác nhận để người tiêu dùng/người đại diện có thể xem lại.
Tách rõ đồng ý sử dụng dịch vụ với đồng ý sử dụng hình ảnh/câu chuyện cho marketing; không coi việc sử dụng dịch vụ là đồng ý quảng bá hình ảnh.
4. Minh bạch giá và bảo vệ tài chính
Thông báo trước về giá, kỳ thanh toán, khoản có thể phát sinh và điều kiện hủy/hoàn.
Không thu khoản phí ngoài Báo giá/Hợp đồng/xác nhận đã được chấp thuận.
Không để Chăm sóc viên vay/mượn tiền, tài sản hoặc yêu cầu khách hàng chuyển tiền vào tài khoản cá nhân không được Elite Care xác nhận.
Khi người tiêu dùng có dấu hiệu khó hiểu về giá hoặc chi phí, CSKH phải giải thích lại và có thể gửi bản tóm tắt bằng văn bản/tin nhắn.
Không dùng tình trạng bệnh, nỗi sợ biến chứng hoặc sự phụ thuộc để gây áp lực mua gói dài hơn hoặc đắt hơn nhu cầu đã được đánh giá.
5. Bảo vệ trong quá trình chăm sóc tại nhà
Tôn trọng quyền riêng tư, thói quen, tín ngưỡng và không gian sống của người được chăm sóc.
Chỉ thực hiện công việc trong phạm vi dịch vụ, kế hoạch chăm sóc và năng lực đã được xác nhận; không tự ý chẩn đoán, kê đơn, thay đổi thuốc/phác đồ hoặc thực hiện kỹ thuật y tế ngoài phạm vi được cấp phép hoạt động kinh doanh.
Ưu tiên phòng ngừa các nguy cơ chăm sóc như té ngã, sặc, loét tì đè, nhiễm khuẩn và báo cáo dấu hiệu bất thường theo quy trình.
Ghi nhận, bàn giao và báo cáo để gia đình/người đại diện theo dõi tình trạng chăm sóc.
Nếu Chăm sóc viên không phù hợp, Elite Care tiếp nhận phản hồi và xem xét phương án điều chỉnh/thay thế theo nguồn lực và mức độ an toàn của ca.
6. Quyền riêng tư và dữ liệu sức khỏe
Thông tin sức khỏe, hồ sơ xuất viện, thuốc, khả năng vận động, hình ảnh và thông tin chăm sóc có thể là dữ liệu cá nhân nhạy cảm. Elite Care xử lý theo Chính sách Bảo mật và Bảo vệ dữ liệu cá nhân, chỉ trong phạm vi mục đích/căn cứ hợp pháp và áp dụng biện pháp bảo vệ phù hợp.
Khi người thân cung cấp dữ liệu của người được chăm sóc, Elite Care có thể yêu cầu xác nhận tư cách/ủy quyền phù hợp nếu cần.
Hạn chế thu thập thông tin không cần thiết; hạn chế chia sẻ trong nội bộ theo nguyên tắc cần biết để cung cấp dịch vụ.
Không công khai hình ảnh, tình trạng bệnh hoặc câu chuyện cá nhân phục vụ marketing nếu chưa có cơ chế đồng ý của chủ thể dữ liệu cá nhân theo quy định của pháp luật.
7. Tiếp nhận yêu cầu bảo vệ và khiếu nại ưu tiên

Elite Care ưu tiên tiếp nhận, xử lý yêu cầu bảo vệ khi người tiêu dùng dễ bị tổn thương cung cấp thông tin/chứng cứ hợp lý về tình trạng và quyền lợi bị ảnh hưởng.
Không chuyển yêu cầu sang bên thứ ba giải quyết, trừ trường hợp bên thứ ba có nghĩa vụ liên quan hoặc việc phối hợp là cần thiết theo pháp luật/hợp đồng.
Nếu từ chối yêu cầu, Elite Care trả lời bằng văn bản hoặc phương thức lưu vết phù hợp, nêu rõ căn cứ pháp lý và sự không phù hợp của yêu cầu với nội dung chính sách đã công bố.
Khiếu nại liên quan an toàn người bệnh, tài sản, bảo mật hoặc dấu hiệu lạm dụng được ưu tiên chuyển Điều phối/Kiểm soát chất lượng/Quản lý.
Trường hợp khẩn cấp về sức khỏe, ưu tiên gọi 115/cơ sở y tế thay vì chờ quy trình khiếu nại.
8. Hỗ trợ tiếp cận và giao tiếp
Có thể cung cấp bản tóm tắt nội dung quan trọng qua chữ viết/tin nhắn để người nghe kém có thể đọc lại.
Cho phép người dùng nhờ người thân/người hỗ trợ tham gia cuộc gọi hoặc nhận thông tin nếu có căn cứ đồng ý/đại diện phù hợp.
Ưu tiên sắp xếp thời điểm liên hệ phù hợp với thể trạng, lịch điều trị/nghỉ ngơi và khả năng tiếp nhận của người được chăm sóc.
Không từ chối tiếp nhận yêu cầu chỉ vì khác biệt về tiếng nói, chữ viết, phong tục hoặc tập quán; Elite Care nỗ lực tìm cách giao tiếp phù hợp trong khả năng hợp lý.
9. Trách nhiệm đào tạo và giám sát nội bộ
Nhân sự CSKH, Sales/Partnership, Lượng giá, Điều phối và Chăm sóc viên phải được phổ biến các nguyên tắc bảo vệ quyền lợi người tiêu dùng dễ bị tổn thương phù hợp vai trò, sự phân công và chỉ đạo từ Elite Care.
Không dùng KPI/doanh số để hợp thức hóa hành vi gây áp lực hoặc cung cấp thông tin sai lệch.
Phản ánh liên quan đến kỳ thị, ép buộc, tài chính, quyền riêng tư hoặc an toàn phải được ghi nhận để kiểm soát chất lượng và khắc phục.
10. Hiệu lực và cập nhật
Chính sách có hiệu lực từ 28/09/2026, được công bố trên website và áp dụng cùng Điều khoản Sử dụng, Chính sách Bảo mật, Chính sách Thanh toán, Chính sách Hủy/Hoàn phí và Chính sách Giải quyết khiếu nại. Elite Care cập nhật khi pháp luật hoặc mô hình dịch vụ thay đổi.

POLICY ON THE PROTECTION OF VULNERABLE CONSUMERS
| Elite Care’s Commitment Due to the nature of home care services, Elite Care regularly serves elderly persons, seriously ill persons, and families under caregiving pressure. Elite Care undertakes not to exploit vulnerability to pressure transactions, not to discriminate, and to prioritize appropriate support mechanisms so that consumers can understand, make choices, and exercise their rights. |
1. Protected Persons
Under the Law on Protection of Consumers’ Rights, vulnerable consumers are consumers who are likely to suffer greater adverse impacts in accessing information, health, property, or dispute resolution at the time of purchasing/using services, including:
Elderly persons in accordance with the laws on the elderly.
Persons with disabilities in accordance with the laws on persons with disabilities.
Children in accordance with the laws on children.
Ethnic minority persons; persons living in ethnic minority and mountainous areas, islands, or areas with difficult or extremely difficult socio-economic conditions in accordance with applicable law.
Pregnant women or women raising children under 36 months of age.
Persons suffering from life-threatening diseases as prescribed by law.
Members of poor households in accordance with applicable law.
In addition to the groups prescribed by law, Elite Care may apply similar support measures to persons experiencing cognitive impairment, hearing/speech difficulties, reading comprehension difficulties, poor health, or family circumstances that make it difficult to receive information and make decisions.

2. Protection Principles
Respect the dignity, privacy, autonomy, and lawful interests of the person receiving care.
Do not stigmatize, discriminate against, or exploit age, illness, disability, financial circumstances, dependency, or anxiety to pressure a person into purchasing/continuing services.
Provide clear, easy-to-understand information within the appropriate scope; do not use treatment guarantees, fear-inducing language, or create a sense that the customer “must buy now” to close a service transaction.
Prioritize the safety and interests of the person receiving care where sales objectives conflict with actual needs.
Support consumers in exercising their rights to lodge complaints, request dispute resolution, and exercise personal data rights through methods appropriate to their abilities and in compliance with applicable law.
3. Support Mechanisms During Consultation and Contracting
Explain the services in plain language; break down information regarding scope, price, schedule, responsibilities of the parties, risks, and professional limitations.
Allow and encourage the participation of a family member/support person/representative where the consumer so wishes, while respecting the wishes of the person receiving care to the extent permitted by law.
Confirm understanding by summarizing the key points and asking whether the consumer needs any further explanation.
Do not require a signature/confirmation where there are indications that the consumer does not understand material content, is in an emergency condition, is not fully conscious, or there are doubts regarding representative authority; where necessary, verify the lawful/authorized representative.
Provide a copy of the contract, quotation, care plan, or confirmation so that the consumer/representative can review it.
Clearly separate consent to use the services from consent to use images/stories for marketing; use of the services must not be treated as consent to publicize images.
4. Pricing Transparency and Financial Protection
Provide advance notice of prices, payment periods, potential additional charges, and cancellation/refund conditions.
Do not collect any charges beyond those set out in an approved Quotation/Contract/confirmation.
Caregivers must not borrow money or property, or ask customers to transfer money to personal accounts not confirmed by Elite Care.
Where a consumer shows signs of difficulty understanding prices or costs, Customer Service must explain them again and may send a written/message summary.
Do not use a medical condition, fear of complications, or dependency to pressure a consumer into purchasing a longer or more expensive package than the assessed need.
5. Protection During Home Care
Respect the privacy, habits, beliefs, and living space of the person receiving care.
Perform work only within the confirmed service scope, care plan, and competence; do not independently diagnose, prescribe, change medications/treatment regimens, or perform medical techniques outside the scope permitted under the licensed business activities.
Prioritize prevention of care-related risks such as falls, choking, pressure ulcers, and infections, and report abnormal signs in accordance with procedures.
Record, hand over, and report information so that the family/representative can monitor the care status.
If a Caregiver is unsuitable, Elite Care will receive feedback and consider an adjustment/replacement option based on available resources and the safety level of the case.
6. Privacy and Health Data
Health information, discharge records, medications, mobility, images, and care information may constitute sensitive personal data. Elite Care processes such data in accordance with the Privacy and Personal Data Protection Policy, solely within the scope of lawful purposes/legal bases and with appropriate safeguards.
Where a family member provides data relating to the person receiving care, Elite Care may require appropriate confirmation of status/authorization where necessary.
Limit the collection of unnecessary information; limit internal sharing on a need-to-know basis for service provision.
Do not disclose images, medical conditions, or personal stories for marketing purposes without a consent mechanism from the personal data subject in accordance with applicable law.
7. Receipt of Protection Requests and Priority Complaints

Elite Care prioritizes the receipt and handling of protection requests where a vulnerable consumer provides reasonable information/evidence regarding their condition and the affected rights and interests.
Do not refer a request to a third party for resolution unless that third party has relevant obligations or coordination is necessary under law/contract.
If a request is refused, Elite Care will respond in writing or by another appropriately traceable method, clearly stating the legal basis and why the request is inconsistent with the published policy.
Complaints concerning patient safety, property, confidentiality, or signs of abuse will be prioritized for referral to Coordination/Quality Control/Management.
In a health emergency, priority should be given to calling 115/a medical facility rather than waiting for the complaint-handling process.
8. Accessibility and Communication Support
A written/message summary of important content may be provided so that persons with hearing difficulties can review it.
Allow users to have a family member/support person participate in a call or receive information where there is an appropriate basis for consent/representation.
Prioritize scheduling contact at a time appropriate to the physical condition, treatment/rest schedule, and ability of the person receiving care to receive information.
Do not refuse to receive a request solely because of differences in spoken language, written language, customs, or practices; Elite Care will make reasonable efforts to identify an appropriate method of communication.
9. Internal Training and Supervision Responsibilities
Customer Service, Sales/Partnership, Assessment, Coordination personnel, and Caregivers must be briefed on the principles for protecting the rights and interests of vulnerable consumers in a manner appropriate to their roles, assignments and directions from Elite Care.
Do not use KPIs/sales targets to justify pressure tactics or the provision of misleading information.
Reports concerning discrimination, coercion, financial matters, privacy, or safety must be recorded for quality control and remediation.
10. Effectiveness and Updates
This Policy takes effect on 28/09/2026, is published on the website, and applies together with the Terms of Use, Privacy Policy, Payment Policy, Cancellation/Refund Policy, and Complaint Resolution Policy. Elite Care will update this Policy when the law or service model changes.
