Lưu ý quan trọng trước khi sử dụng website
Website Elite Care cung cấp thông tin, công cụ liên hệ và hỗ trợ đăng ký dịch vụ chăm sóc tại nhà. Nội dung trên website không thay thế việc khám bệnh, chẩn đoán, kê đơn hoặc điều trị của bác sĩ hay nhân sự y tế có chuyên môn hành nghề khám bệnh, chữa bệnh.
Website không phải kênh cấp cứu. Khi có dấu hiệu khẩn cấp hoặc nguy cơ đe dọa tính mạng/sức khỏe, người dùng cần liên hệ 115 hoặc cơ sở y tế phù hợp thay vì chờ phản hồi từ website/CSKH.

1. Phạm vi áp dụng và việc chấp thuận điều khoản

Điều khoản Sử dụng này điều chỉnh việc truy cập, xem, tìm kiếm thông tin, gửi biểu mẫu, đăng ký tư vấn, đăng ký đánh giá, yêu cầu cung cấp dịch vụ, gửi phản hồi hoặc sử dụng các tính năng khác trên website chính thức của Elite Care.

Bằng việc truy cập hoặc tiếp tục sử dụng website, người dùng xác nhận đã đọc, hiểu và đồng ý tuân thủ Điều khoản Sử dụng này cùng các chính sách được dẫn chiếu. Nếu không đồng ý, người dùng nên ngừng sử dụng website hoặc không sử dụng chức năng liên quan.

Việc chấp thuận Điều khoản Sử dụng không thay thế Hợp đồng dịch vụ hoặc các thỏa thuận riêng giữa Elite Care và khách hàng. Khi phát sinh giao dịch cụ thể, quyền và nghĩa vụ của các bên còn được điều chỉnh bởi hợp đồng, báo giá, xác nhận dịch vụ và chính sách áp dụng tại thời điểm giao dịch.

3. Giải thích từ ngữ

“Elite Care” hoặc “Chúng tôi”: CÔNG TY TNHH CHĂM SÓC SỨC KHỎE VÀ GIA ĐÌNH TÂM AN và các bộ phận được ủy quyền vận hành website/cung cấp dịch vụ.

“Website”: tên miền chính thức elite-healthcare.com.vn và các trang, landing page hoặc chức năng trực thuộc do Elite Care quản lý.

“Người dùng”: cá nhân hoặc tổ chức truy cập, tìm hiểu, gửi thông tin, đăng ký tư vấn hoặc sử dụng chức năng trên website.

“Khách hàng”: người ký kết, thanh toán hoặc sử dụng dịch vụ Elite Care; có thể khác với người được chăm sóc.

“Người được chăm sóc”: cá nhân có nhu cầu được hỗ trợ chăm sóc tại nhà theo phạm vi dịch vụ đã xác nhận.

4. Mục đích và bản chất thông tin trên website

Website nhằm giới thiệu Elite Care, các nhóm dịch vụ chăm sóc tại nhà, quy trình triển khai, thông tin giáo dục/chăm sóc sức khỏe, chương trình truyền thông và phương thức để khách hàng liên hệ hoặc đăng ký nhu cầu.

Nội dung sức khỏe trên website mang tính thông tin và định hướng chung. Việc một nội dung mô tả dấu hiệu, rủi ro, hoạt động chăm sóc hoặc phục hồi không đồng nghĩa với chẩn đoán, chỉ định điều trị hay cam kết kết quả cho một trường hợp cụ thể.

Phương án chăm sóc chỉ được xác định sau khi Elite Care tiếp nhận đủ thông tin cần thiết và, khi phù hợp, thực hiện đánh giá nhu cầu/tình trạng theo quy trình. Elite Care không cung cấp và không thực hiện các hoạt động liên quan đến khám bệnh, chẩn đoán bệnh, kê đơn thuốc, chỉ định phương pháp chữa bệnh hoặc điều trị bệnh. Các hoạt động chẩn đoán, điều trị, kê đơn, thay đổi thuốc hoặc kỹ thuật y tế phải được thực hiện bởi các bác sĩ, nhân viên y tế có chuyên môn hành nghề khám bệnh chữa bệnh theo quy định pháp luật.

5. Điều kiện sử dụng và trách nhiệm của người dùng

Cung cấp thông tin trung thực, chính xác và cập nhật khi gửi biểu mẫu hoặc yêu cầu tư vấn; không giả mạo danh tính hoặc tư cách đại diện.

Chỉ cung cấp thông tin của người khác, đặc biệt là dữ liệu sức khỏe của người được chăm sóc, khi có căn cứ hợp pháp hoặc được phép theo quy định của pháp luật.

Tự chịu trách nhiệm về thiết bị, kết nối Internet, bảo mật tài khoản email/số điện thoại và các phương tiện dùng để tương tác với website.

Người thực hiện giao dịch phải có năng lực hành vi phù hợp hoặc là người đại diện hợp pháp/được ủy quyền. Trường hợp người dùng chưa thành niên, việc sử dụng các chức năng có phát sinh giao dịch cần có sự tham gia của cha mẹ/người đại diện theo pháp luật khi pháp luật yêu cầu.

Kiểm tra thông tin trước khi xác nhận đăng ký, thanh toán hoặc ký hợp đồng; thông báo sớm cho Elite Care khi phát hiện thông tin sai hoặc giao dịch bất thường.

6. Các hành vi không được phép

Người dùng không được sử dụng website cho mục đích trái pháp luật, gây ảnh hưởng đến quyền, lợi ích hợp pháp của Elite Care, khách hàng, người được chăm sóc hoặc bên thứ ba, bao gồm nhưng không giới hạn:

Xâm nhập, dò quét, phá hoại, gây quá tải, phát tán mã độc, can thiệp trái phép vào hệ thống, dữ liệu, máy chủ hoặc chức năng bảo mật.

Thu thập dữ liệu tự động, sao chép hàng loạt, scraping/crawling hoặc sử dụng bot theo cách ảnh hưởng đến hoạt động website hoặc khai thác dữ liệu trái phép.

Đăng tải/gửi nội dung giả mạo, xúc phạm, đe dọa, vi phạm quyền riêng tư, quyền sở hữu trí tuệ, bí mật kinh doanh hoặc quyền hợp pháp của người khác.

Sử dụng thương hiệu, hình ảnh, tài liệu, nội dung hoặc dữ liệu của Elite Care để gây nhầm lẫn về quan hệ đại diện, hợp tác, bảo trợ hoặc nguồn gốc dịch vụ.

Mạo danh Elite Care, Chăm sóc viên hoặc nhân sự Elite Care; dụ dỗ khách hàng thực hiện giao dịch ngoài kênh chính thức hoặc yêu cầu chuyển tiền đến tài khoản không được Elite Care xác nhận hoặc chấp thuận bằng văn bản.

7. Đăng ký tư vấn, yêu cầu dịch vụ và hình thành giao dịch

Việc gửi biểu mẫu, gọi hotline, nhắn tin, đặt lịch đánh giá hoặc bấm nút đăng ký trên website thể hiện nhu cầu được liên hệ/tư vấn; không mặc nhiên tạo thành hợp đồng cung cấp dịch vụ nếu Elite Care chưa xác nhận phạm vi, thời gian, giá và các điều kiện liên quan.

Giao dịch dịch vụ được hình thành theo nội dung được các bên xác nhận qua hợp đồng, phụ lục, báo giá, đơn/xác nhận dịch vụ hoặc phương thức điện tử hợp pháp khác. Elite Care có quyền từ chối hoặc đề nghị điều chỉnh yêu cầu nếu ngoài phạm vi dịch vụ, vượt năng lực đáp ứng, ngoài khu vực phục vụ hoặc có yếu tố an toàn/chuyên môn cần chuyển đến cơ sở y tế phù hợp.

Thông tin về lịch trống, Chăm sóc viên, chương trình ưu đãi hoặc thời gian bắt đầu trên website có thể thay đổi theo nguồn lực thực tế. Chỉ xác nhận cuối cùng từ Elite Care mới được dùng để bố trí dịch vụ.

8. Giá, thanh toán, chương trình ưu đãi và hoàn phí

Giá dịch vụ, phương thức thanh toán, thời điểm thanh toán, đối soát, hoàn phí hoặc xử lý giao dịch được thực hiện theo báo giá/hợp đồng và Chính sách Thanh toán công bố trên website tại thời điểm áp dụng.

Chương trình ưu đãi chỉ có hiệu lực trong thời gian, đối tượng, khu vực và điều kiện được công bố. Elite Care không có nghĩa vụ thực hiện ưu đãi đã hết hạn, áp dụng sai đối tượng hoặc được phát tán từ nguồn không chính thức.

Nguyên tắc an toàn thanh toán
Khách hàng không nên chuyển tiền theo hướng dẫn từ tài khoản cá nhân hoặc kênh không được Elite Care xác nhận chính thức bằng văn bản.
Khi có nghi ngờ, hãy xác minh qua Hotline/Email chính thức trước khi thanh toán.

9. Dữ liệu cá nhân và quyền riêng tư

Việc thu thập, sử dụng, lưu trữ, chia sẻ và bảo vệ dữ liệu cá nhân khi người dùng tương tác với website được thực hiện theo Chính sách Bảo mật và Bảo vệ Dữ liệu cá nhân của Elite Care và quy định pháp luật hiện hành.

Dữ liệu sức khỏe, thông tin chăm sóc, hình ảnh/video có thể thuộc nhóm dữ liệu nhạy cảm hoặc liên quan chặt chẽ đến quyền riêng tư. Người dùng cần hạn chế gửi thông tin không cần thiết qua kênh công khai và chỉ sử dụng biểu mẫu/kênh do Elite Care chỉ định.

10. Sở hữu trí tuệ và phạm vi sử dụng nội dung

Trừ khi có thông báo khác, nhãn hiệu, tên thương mại, logo, bố cục, văn bản, hình ảnh, video, đồ họa, biểu mẫu, quy trình trình bày, tài liệu đào tạo và nội dung do Elite Care tạo lập hoặc sở hữu trên website được bảo hộ theo pháp luật về sở hữu trí tuệ và pháp luật có liên quan.

Người dùng được xem, tải hoặc in nội dung cho mục đích cá nhân, phi thương mại và phục vụ việc tìm hiểu/sử dụng dịch vụ, với điều kiện không sửa đổi sai lệch, xóa thông tin quyền sở hữu hoặc sử dụng theo cách gây nhầm lẫn.

Mọi việc sao chép có hệ thống, khai thác thương mại, tái xuất bản, phân phối, cấp phép lại, chuyển thể, sử dụng logo/nhãn hiệu hoặc dùng nội dung làm tài liệu quảng cáo của bên khác cần có chấp thuận trước bằng văn bản của Elite Care, trừ trường hợp pháp luật cho phép.

11. Nội dung và tài liệu do người dùng cung cấp

Khi gửi đánh giá, phản hồi, hình ảnh, hồ sơ hoặc tài liệu cho Elite Care, người dùng cam kết có quyền cung cấp nội dung đó và nội dung không xâm phạm quyền của bên thứ ba.

Elite Care chỉ sử dụng nội dung người dùng cung cấp trong phạm vi cần thiết để tiếp nhận nhu cầu, đánh giá, cung cấp dịch vụ, chăm sóc khách hàng, giải quyết khiếu nại hoặc mục đích khác đã được thông báo/có căn cứ hợp pháp. Việc sử dụng hình ảnh, câu chuyện khách hàng cho hoạt động truyền thông/marketing cần được thực hiện theo cơ chế đồng ý phù hợp, không được suy diễn chỉ từ việc khách hàng gửi tài liệu để phục vụ chăm sóc.

12. Liên kết và nền tảng của bên thứ ba

Website có thể chứa liên kết đến bản đồ, mạng xã hội, cổng thanh toán, công cụ đặt lịch hoặc website của bên thứ ba. Các dịch vụ này có điều khoản và chính sách riêng; Elite Care không kiểm soát toàn bộ nội dung hoặc hoạt động kỹ thuật của bên thứ ba.

Việc hiển thị liên kết không mặc nhiên đồng nghĩa Elite Care xác nhận, bảo lãnh hoặc chịu trách nhiệm cho mọi nội dung/dịch vụ của bên thứ ba. Người dùng nên đọc điều khoản và chính sách riêng trước khi cung cấp dữ liệu hoặc thực hiện giao dịch trên nền tảng khác.

13. Tính sẵn sàng, bảo trì và an toàn website

Elite Care nỗ lực duy trì website hoạt động ổn định và thông tin cập nhật, nhưng không bảo đảm website luôn không gián đoạn hoặc không có lỗi trong mọi thời điểm. Website có thể tạm ngừng để bảo trì, nâng cấp, xử lý sự cố, yêu cầu an ninh hoặc nguyên nhân ngoài khả năng kiểm soát hợp lý.

Elite Care có thể áp dụng biện pháp kỹ thuật, giới hạn truy cập, chặn yêu cầu bất thường hoặc tạm ngừng một chức năng khi cần thiết để bảo vệ hệ thống, dữ liệu và người dùng.

14. Miễn trừ thông tin và giới hạn trách nhiệm

14.1. Không thay thế tư vấn y tế

Thông tin trên website không phải là chẩn đoán, đơn thuốc, phác đồ điều trị hoặc lời khuyên cấp cứu. Tình trạng sức khỏe cần được đánh giá bởi bác sĩ/cơ sở y tế hoặc người hành nghề khám bệnh, chữa bệnh có chuyên môn y tế theo quy định của pháp luật trong trường hợp chuyên môn yêu cầu.

14.2. Phạm vi trách nhiệm của Elite Care

Trong phạm vi pháp luật cho phép, Elite Care không chịu trách nhiệm đối với tổn thất phát sinh chỉ do người dùng tự diễn giải hoặc tự áp dụng nội dung website thay cho tư vấn chuyên môn; do người dùng cung cấp thông tin sai/thiếu; do sự cố thiết bị, đường truyền, nền tảng bên thứ ba hoặc sự kiện ngoài khả năng kiểm soát hợp lý của Elite Care.

Không nội dung nào trong Điều khoản này được hiểu là loại trừ hoặc hạn chế trách nhiệm mà Elite Care bắt buộc phải chịu theo pháp luật, quyền bắt buộc của người tiêu dùng, hoặc trách nhiệm phát sinh từ lỗi/vi phạm hợp đồng của Elite Care theo quy định áp dụng.

15. Tạm ngừng hoặc chấm dứt quyền truy cập

Elite Care có thể tạm ngừng, giới hạn hoặc chấm dứt quyền sử dụng một số chức năng của người dùng nếu có căn cứ hợp lý cho rằng người dùng vi phạm Điều khoản, có hành vi gây mất an toàn hệ thống, xâm phạm quyền của người khác, gian lận hoặc sử dụng website trái pháp luật. Biện pháp áp dụng phải phù hợp với tính chất, mức độ rủi ro và quy định pháp luật.

16. Sửa đổi Điều khoản Sử dụng

Elite Care có thể cập nhật Điều khoản để phản ánh thay đổi pháp luật, dịch vụ, quy trình hoặc công nghệ. Phiên bản mới sẽ được công bố trên website kèm ngày hiệu lực.

Việc cập nhật không làm giảm các quyền bắt buộc của người tiêu dùng theo pháp luật và không tự động sửa đổi quyền, nghĩa vụ đã được xác lập trong hợp đồng dịch vụ trước đó, trừ khi pháp luật yêu cầu hoặc các bên có thỏa thuận hợp lệ.

17. Phản hồi, hỗ trợ và khiếu nại

Người dùng có thể liên hệ Elite Care qua Hotline 0931 77 22 80 hoặc Email cskh@elite-healthcare.com.vn để yêu cầu hỗ trợ về website, giao dịch, quyền riêng tư hoặc dịch vụ.

Khiếu nại của khách hàng được tiếp nhận và xử lý theo Chính sách Tiếp nhận và Giải quyết khiếu nại công bố trên website. Trường hợp phản ánh liên quan đến an toàn người bệnh, tài sản, bảo mật hoặc dấu hiệu khẩn cấp, Elite Care có thể ưu tiên chuyển ngay đến bộ phận Điều phối/Kiểm soát chất lượng/Quản lý hoặc hướng dẫn liên hệ cơ sở y tế phù hợp.

18. Luật áp dụng và giải quyết tranh chấp

Điều khoản Sử dụng này được điều chỉnh bởi pháp luật Việt Nam. Các bên ưu tiên trao đổi, thương lượng và giải quyết thiện chí. Trường hợp không đạt được thỏa thuận, người dùng/khách hàng có quyền sử dụng các phương thức giải quyết tranh chấp theo quy định của pháp luật, bao gồm cơ chế bảo vệ quyền lợi người tiêu dùng và yêu cầu cơ quan nhà nước có thẩm quyền giải quyết theo quy định của pháp luật.

Không điều khoản nào hạn chế quyền của người tiêu dùng lựa chọn cơ chế giải quyết tranh chấp mà pháp luật cho phép hoặc đặt ra nghĩa vụ bất lợi hơn so với quy định bắt buộc của pháp luật.

19. Thứ tự ưu tiên và tính độc lập của điều khoản

Nếu có khác biệt giữa Điều khoản Sử dụng và một Hợp đồng dịch vụ đã ký hợp lệ, nội dung cụ thể của Hợp đồng dịch vụ được ưu tiên cho giao dịch đó, trừ khi pháp luật quy định khác. Chính sách Bảo mật, Chính sách Thanh toán và Chính sách Giải quyết khiếu nại là các tài liệu bổ trợ và được áp dụng theo phạm vi riêng.

Nếu một phần của Điều khoản bị xác định là vô hiệu hoặc không thể thi hành, các phần còn lại vẫn tiếp tục có hiệu lực trong phạm vi pháp luật cho phép; phần bị ảnh hưởng được điều chỉnh hoặc thay thế bằng một điều khoản hợp lệ mới phản ánh gần nhất với mục đích hợp pháp ban đầu.

20. Hiệu lực

Điều khoản Sử dụng này có hiệu lực từ ngày 28/09/2026 và áp dụng cho website chính thức của Elite Care kể từ thời điểm công bố. Phiên bản hiện hành được nhận diện bằng số phiên bản và ngày hiệu lực hiển thị trên tài liệu/website.

Khuyến nghị triển khai trên website
Đặt liên kết “Điều khoản sử dụng” tại footer cùng Chính sách bảo mật, Chính sách thanh toán và Chính sách giải quyết khiếu nại.
Tại các form đăng ký quan trọng, nên có checkbox hoặc dòng xác nhận đã đọc/đồng ý với Điều khoản sử dụng và Chính sách bảo mật khi pháp luật hoặc mục đích xử lý dữ liệu yêu cầu.
Các nút CTA nên mô tả đúng bản chất: “Đăng ký tư vấn”, “Đặt lịch đánh giá”, “Gửi yêu cầu” thay vì tạo cảm giác hợp đồng đã tự động hình thành nếu quy trình thực tế còn bước xác nhận.

These Terms of Use govern access to, viewing of, and searches for information, submission of forms, registration for consultation, registration for assessment, requests for services, submission of feedback, and use of other functions on the official Elite Care website.

By accessing or continuing to use the website, the User confirms that the User has read, understood, and agrees to comply with these Terms of Use and the policies referenced herein. If the User does not agree, the User should stop using the website or refrain from using the relevant function.

Acceptance of these Terms of Use does not replace a Service Agreement or any separate agreement between Elite Care and the Customer. When a specific transaction arises, the rights and obligations of the parties are also governed by the applicable agreement, quotation, service confirmation, and policies in effect at the time of the transaction.

3. Definitions

“Elite Care” or “We”: TAM AN FAMILY AND HEALTH CARE COMPANY LIMITED and the departments authorized to operate the website/provide services.

“Website”: the official domain elite-healthcare.com.vn and the pages, landing pages, or subordinate functions managed by Elite Care.

“User”: an individual or organization that accesses, reviews, submits information, registers for consultation, or uses functions on the Website.

“Customer”: a person who enters into an agreement, makes payment, or uses Elite Care services; this person may differ from the Care Recipient.

“Care Recipient”: an individual who requires home care support within the confirmed scope of services.

4. Purpose and Nature of Information on the Website

The Website is intended to introduce Elite Care, home care service categories, implementation processes, educational/healthcare information, communication programs, and methods for Customers to contact Elite Care or register their needs.

Health-related content on the Website is provided for general information and guidance. A description of signs, risks, care activities, or recovery does not constitute a diagnosis, treatment instruction, or guarantee of results for any specific case.

A care plan is determined only after Elite Care has received sufficient necessary information and, where appropriate, conducted an assessment of needs/condition in accordance with its procedures. Elite Care does not provide or perform activities relating to medical examination, diagnosis, prescription of medication, indication of treatment methods, or medical treatment. Diagnosis, treatment, prescription, medication changes, or medical techniques must be carried out by doctors and healthcare professionals qualified to practice medical examination and treatment in accordance with law.

5. Conditions of Use and User Responsibilities

Provide truthful, accurate, and up-to-date information when submitting forms or requesting consultation; do not impersonate another person or misrepresent representative capacity.

Provide another person’s information, particularly health data of the Care Recipient, only where there is a lawful basis or such provision is permitted by law.

Be responsible for the User’s devices, Internet connection, security of email/phone accounts, and other means used to interact with the Website.

A person carrying out a transaction must have the requisite legal capacity or be a lawful/authorized representative. Where the User is a minor, use of functions involving transactions must involve a parent/legal representative where required by law.

Verify information before confirming registration, payment, or execution of an agreement; promptly notify Elite Care upon discovering incorrect information or an unusual transaction.

6. Prohibited Conduct

Users must not use the Website for unlawful purposes or in a manner that adversely affects the lawful rights and interests of Elite Care, Customers, Care Recipients, or third parties, including but not limited to:

Unauthorized access, scanning, sabotage, overloading, dissemination of malware, or unlawful interference with systems, data, servers, or security functions.

Automated data collection, bulk copying, scraping/crawling, or use of bots in a manner that affects Website operations or unlawfully exploits data.

Posting/sending fraudulent, insulting, threatening, or otherwise unlawful content, or content that infringes privacy rights, intellectual property rights, trade secrets, or other lawful rights of another person.

Using Elite Care’s brand, images, documents, content, or data in a manner that causes confusion regarding agency, cooperation, sponsorship, or the source of services.

Impersonating Elite Care, a Caregiver, or Elite Care personnel; inducing Customers to transact outside official channels; or requesting transfers to an account that has not been officially confirmed or approved in writing by Elite Care.

7. Consultation Registration, Service Requests, and Formation of Transactions

Submitting a form, calling the hotline, sending a message, scheduling an assessment, or clicking a registration button on the Website indicates a request to be contacted/consulted; it does not automatically create a service agreement unless Elite Care has confirmed the scope, time, price, and related conditions.

A service transaction is formed based on the terms confirmed by the parties through an agreement, appendix, quotation, service order/confirmation, or other lawful electronic means. Elite Care may refuse or propose adjustments to a request if it falls outside the service scope, exceeds available capacity, is outside the service area, or involves safety/professional factors requiring referral to an appropriate medical facility.

Information on availability, Caregivers, promotional programs, or starting times on the Website may change depending on actual resources. Only final confirmation from Elite Care may be relied upon for service arrangements.

8. Prices, Payment, Promotional Programs, and Refunds

Service prices, payment methods, payment timing, reconciliation, refunds, or transaction handling shall be implemented in accordance with the quotation/agreement and the Payment Policy published on the Website and effective at the relevant time.

A promotional program is valid only for the published period, eligible persons, area, and conditions. Elite Care is not obligated to honor an expired promotion, a promotion applied to an ineligible person, or a promotion circulated from an unofficial source.

Payment Safety Principles
Customers should not transfer money based on instructions from a personal account or a channel that has not been officially confirmed in writing by Elite Care.

9. Personal Data and Privacy

The collection, use, storage, sharing, and protection of personal data when a User interacts with the Website are carried out in accordance with Elite Care’s Privacy and Personal Data Protection Policy and applicable laws.

10. Intellectual Property and Permitted Use of Content

Use of Customer images or stories for communications/marketing must be based on an appropriate consent mechanism and must not be inferred merely from the Customer’s submission of materials for care purposes.

12. Third-Party Links and Platforms

The Website may contain links to maps, social networks, payment gateways, scheduling tools, or third-party websites. These services have their own terms and policies; Elite Care does not control all content or technical operations of third parties.

Display of a link does not automatically mean that Elite Care endorses, guarantees, or accepts responsibility for all third-party content/services. Users should review the relevant terms and policies before providing data or carrying out transactions on another platform.

13. Website Availability, Maintenance, and Security

Elite Care endeavors to maintain stable Website operation and up-to-date information but does not guarantee that the Website will be uninterrupted or error-free at all times. The Website may be temporarily unavailable for maintenance, upgrades, incident handling, security requirements, or causes beyond Elite Care’s reasonable control.

Elite Care may apply technical measures, access restrictions, block unusual requests, or temporarily suspend a function where necessary to protect systems, data, and Users.

14.1. Not a Substitute for Medical Advice

Information on the Website is not a diagnosis, prescription, treatment regimen, or emergency advice. Where professional assessment is required, a health condition must be evaluated by a doctor/medical facility or a practitioner qualified in medical examination and treatment in accordance with law.

14.2. Scope of Elite Care’s Liability

To the extent permitted by law, Elite Care shall not be liable for losses arising solely because a User independently interprets or applies Website content as a substitute for professional advice; because the User provides incorrect/incomplete information; because of failures of devices, connections, or third-party platforms; or because of events beyond Elite Care’s reasonable control.

Nothing in these Terms shall be construed to exclude or limit any liability that Elite Care is mandatorily required to bear under law, any mandatory consumer rights, or liability arising from Elite Care’s fault/breach of contract under applicable law.

15. Suspension or Termination of Access Rights

Elite Care may suspend, restrict, or terminate a User’s right to use certain functions where there are reasonable grounds to believe that the User has violated these Terms, engaged in conduct that compromises system security, infringed another person’s rights, committed fraud, or used the Website unlawfully. Any measure applied must be proportionate to the nature and level of risk and comply with applicable law.

16. Amendments to the Terms of Use

An update does not reduce mandatory consumer rights under law and does not automatically amend rights and obligations established under a prior Service Agreement, unless required by law or validly agreed by the parties.

Where a report concerns patient safety, property, security, or signs of an emergency, Elite Care may prioritize immediate referral to the Coordination/Quality Control/Management department or instruct the User to contact an appropriate medical facility.

18. Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of Vietnam. The parties shall prioritize discussion, negotiation, and good-faith resolution. If no agreement is reached, the User/Customer may use dispute resolution methods permitted by law, including consumer protection mechanisms and requesting a competent state authority to resolve the matter in accordance with law.

No provision restricts a consumer’s right to choose a dispute resolution mechanism permitted by law or imposes obligations that are less favorable than mandatory legal requirements.

19. Order of Precedence and Severability

If there is any inconsistency between these Terms of Use and a duly executed Service Agreement, the specific terms of the Service Agreement shall prevail for that transaction, unless otherwise provided by law. The Privacy Policy, Payment Policy, and Complaint Resolution Policy are supplementary documents and apply within their respective scopes.

If any part of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue in effect to the extent permitted by law; the affected part shall be adjusted or replaced with a new valid provision that most closely reflects the original lawful purpose.
